Page | 43 POSSESSION OF WEAPONS IN THE WORKPLACE 409 The City prohibits its employees from possessing weapons while on duty or while on city property at any time except for as allowed by State of Kansas statute. “Weapons” include, but are not limited to, firearms, explosives, knives and other items that might be considered dangerous or could cause harm. In accordance with state statute, City employees may carry a concealed firearm while at work. For the purposes of this policy, “concealed carry” means that the firearm always remains on the employee’s person and is not visible or easily discernable by others. In all cases, “open carry”, or carrying a firearm on one’s person in such a manner that any portion of the firearm is visible to others, is strictly prohibited. If the employee finds it necessary to store a concealed firearm while on duty, the employee will be solely responsible for securing the firearm either in their personal vehicle or in a locked case that has been pre-approved by management. In the event that an employee draws a concealed carry weapon while on-duty due to a perceived threat, the employee should immediately contact and report the incident to law enforcement and his/her immediate supervisor. Brandishing, displaying, drawing, handling, cleaning or otherwise using a firearm in an unconcealed manner when not necessary for the protection of the employee or others will constitute an act of workplace violence that will be reported to law enforcement and subject the employee to immediate termination of employment. The City assumes no liability for any incidents involving the use or misuse of a concealed carry firearm, or any loss or theft of a firearm. Employees who choose to conceal carry a firearm at work are solely responsible for fully understanding and complying with all aspects of state and federal law and shall assume all liabilities associated with concealed carry and the use of a firearm. Failure to follow state and federal concealed carry laws, including but not limited to violating no-carry zones, will subject the employee to disciplinary action up to and including termination of employment. Sworn law enforcement personnel are exempt from this policy unless such privileges have been suspended by the Chief of Police.
