Page | 31 The IT department also maintains a small pool of cellular phones that may be temporarily checked out to City employees on an as-needed basis. Usage Limitations – Employees may not use City-issued cellular devices for any non-City business whether on or off duty. Additionally, the general use of cellular devices shall not be in lieu of more cost effective, practical and available means of communications. Cellular Phone Allowance – The City recognizes that certain positions require the employees to use a cellular phone to conduct City business on an infrequent/limited basis. In such cases, the department head may request that the employee be provided a cellular phone allowance. This cellular phone allowance will be determined by the estimated use of a personal cell phone for City business and is subject to change without notice. When an allowance is provided, the employee must agree to use their personal cellular phone for work-related communications as needed. Additionally, the employee will be expected to: • Have the work phone charged and ready for use during normal working hours and at times when work communication is anticipated or required; • Provide his/her own personal mobile phone and be responsible for the maintenance and upkeep; • Be responsible for the purchase and maintenance of their own cellular phone plan and contract; and • Provide their mobile phone number to their Department Head and Human Resources. In the event of an emergency or special circumstance where the employee is forced to use an unusually large quantity of mobile phone minutes, the employee may be entitled to an additional one-time compensation to offset the additional charges to his/her mobile phone bill. The employee’s Department Director and City Manager shall review these requests on a case-by-case basis to determine if the employee is eligible. The City’s cellular device policy is intended to ensure compliance with the Internal Revenue Code. Correspondingly, the cellular device allowance will be paid as a miscellaneous addition to the employee’s income and is subject to FICA as well as federal and state income tax withholding. Employees may elect to maintain records detailing their business use of their personal cell phone and deduct such documented expenses as a business expense when filing their personal income tax returns. PERSONAL SOCIAL MEDIA ACCOUNTS 319 The City respects the right of any employee to maintain a website or blog or to participate in social and professional networking on or through websites or services such as Twitter, Facebook, LinkedIn, Instagram, or similar sites/services. However, to protect the City’s interests and ensure employees focus on their job duties, employees must adhere to the following rules: • Employees may not post on a blog or website or participate in social networking during work time; • All rules regarding confidential and proprietary information apply in full to employees’ use of blogs, websites and networking services. Any information that could not be disclosed through a conversation, a note or an e-mail also cannot be disclosed on a blog, a website, or as part of employees’ participation in social or professional networking;
