Page | 26 Drug Testing – Controlled substances tested under the requirements of this policy include marijuana, cocaine, opiates, phencyclidine an amphetamines/methamphetamine. In addition, the City may at any time require testing for any drugs covered by The Kansas Controlled Substances Act. When possible, the test shall be conducted by analyzing an employee’s urine; however, the city reserves the right to administer other methods of testing at its discretion. An approved laboratory will conduct the initial drug screening test using enzyme-multiplied immunoassay technology (EMIT). If the initial screening is positive, a confirmatory test will be conducted using gas chromatography/mass spectrometry (GC/MS) techniques. For a positive test, the thresholds shall be: All confirmed positive test results will be sent to a city-approved medical review officer (MRO) for further examination, interpretation, and explanation. The MRO will make reasonable efforts to contact the employee to determine if the positive result may have been caused by prescribed medicine or other legitimate factors. If it is determined that there is a legitimate medical explanation for the positive test result, and that the result is consistent with the lawful use of a drug, then the test result shall be reported as negative. The MRO will report a positive test if there is not a legitimate reason to invalidate the test. If the Medical Review Officer (MRO) reports a negative random drug (urine) test was dilute, the employee is subject to immediate re-test and shall be notified of the test in the same manner as listed in this procedure. The result of the second test shall be considered the test of record. Refusal to Test – Employee may not refuse to submit to any requested alcohol or drug test. An employee will be deemed to have refused to submit to an alcohol or drug test in the following circumstances: • Failure to appear for any test at the time determined by the employer, after being directed to do so by the employer. This includes the failure of an employee to appear for testing in a timely manner without good cause. • Failure to remain at the testing site until the collection and/or testing process has been completed. • Failure to permit a directly observed or monitored specimen collection if required to do so. • Failure to provide a sufficient amount of urine when directed, and it has been determined through a required medical evaluation, that there was not an adequate medical explanation for the failure. • Failure or refusal to take a second test, following an inconclusive test result. • Failure to undergo a medical examination or evaluation, as directed by the Medical Review Officer as part of the verification process, or as directed by the City.
